Beyond the Primer: What Exactly IS Negligence and How Will it Get You Sued?

In 2006, ATTA began bringing to its members the first in a series of articles on the general topic of risk management specifically addressing the needs and interests of U.S. based or licensed tour operators. The first in this series addressed some general primer concepts involved in considering legal precedents and discussed a four step process for doing risk management and risk management planning within an organization. The original "primer" document is available here. Tracey Knutson (read her bio) will now present the second risk management oriented article and Webinar for ATTA Members. The article will be available on the ATTA website by July 12th and the Webinar will take place on August 15th.
Following on the original topic of risk management planning, Tracey will address how to actually define naughty (liability inducing) conduct and how that conduct manifests or results in lawsuits. Tracey will distinguish between negligence (liability inducing) and inherent risk (no liability for inherent risks) and teach Webinar participants to know the difference. She will discuss the 6 most common types of negligence oriented claims made against outdoor providers and how to use the planning process detailed in the first article to anticipate these types of claims and to mitigate against them. As always, Tracey will invite all Webinar participants into a lively Q & A.
